C&J Designs LLC — Terms of Service

Effective date: October 31, 2026

1. Agreement and Scope

These Terms govern purchases from C&J Designs LLC ("we," "us," "our") through candj-designs.com. By placing an order after these Terms are presented, the purchaser agrees to them, subject to applicable law. A separately signed commercial or custom-order agreement controls to the extent it expressly conflicts with these Terms. C&J Designs LLC may reject or cancel orders for legitimate business reasons, including suspected fraud, product unavailability, or material listing errors, subject to applicable refund obligations.

2. Independent Purchaser Judgment

All products are aftermarket accessories. The purchaser independently determines whether each product is suitable for the purchaser's vehicle, equipment, application, and intended use. Unless expressly confirmed in writing by C&J Designs LLC, no representation is made that a product is appropriate for a particular application or permitted in every jurisdiction. The purchaser is responsible for checking compatibility, installation requirements, and applicable laws before purchase, installation, and use.

3. Sole Responsibility for Installation and Use

The purchaser has sole responsibility for selecting an installer and for installation, wiring, mounting, integration, configuration, operation, inspection, maintenance, removal, and lawful use of each product. C&J Designs LLC does not direct, supervise, inspect, approve, or assume responsibility for installation or services performed by a purchaser or independent third party. The purchaser must comply with all applicable instructions, warnings, vehicle requirements, and laws and must discontinue use if an unsafe condition is suspected. The purchaser is responsible for the conduct and workmanship of any installer the purchaser retains.

4. Allocation of Installation and Use Risks

TO THE MAXIMUM EXTENT PERMITTED BY LAW, C&J Designs LLC SHALL NOT BE RESPONSIBLE FOR CLAIMS, LOSSES, DAMAGES, COSTS, OR EXPENSES TO THE EXTENT CAUSED BY IMPROPER INSTALLATION, INCORRECT WIRING OR MOUNTING, INCOMPATIBLE APPLICATIONS, UNAUTHORIZED ALTERATIONS, MISUSE, ABUSE, RACING OR OTHER EXTREME USE, FAILURE TO INSPECT OR MAINTAIN, NEGLIGENT OPERATION, OR ACTS OR OMISSIONS OF THE PURCHASER OR ANY THIRD PARTY. The purchaser assumes the risks attributable to the purchaser's chosen application, installation, and use. This allocation does not excuse a product defect or other liability that cannot lawfully be excluded.

5. No Additional Voluntary Manufacturer Warranty

C&J Designs LLC provides no additional voluntary manufacturer warranty unless a specific written warranty is expressly issued by C&J Designs LLC for the purchased product. Third-party components, if accompanied by a manufacturer's warranty, are subject solely to that manufacturer's warranty terms; C&J Designs LLC does not independently extend or administer that warranty unless required by law. TO THE EXTENT PERMITTED BY APPLICABLE LAW, C&J Designs LLC DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. This disclaimer does not negate express written product representations or rights that cannot lawfully be disclaimed. See the separate Warranty and Third-Party Notice.

6. Exclusive Contractual Remedies and Liability Limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW, C&J Designs LLC'S TOTAL LIABILITY FOR A CLAIM ARISING FROM BREACH OF THIS SALES CONTRACT SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO C&J Designs LLC FOR THE PRODUCT GIVING RISE TO THE CLAIM. TO THE SAME EXTENT, C&J Designs LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL ECONOMIC LOSSES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF USE, BUSINESS INTERRUPTION, RACE OR EVENT COSTS, VEHICLE DOWNTIME, OR REPLACEMENT TRANSPORTATION. These limits do not apply to liability or remedies that applicable law does not permit C&J Designs LLC to limit, including certain personal injury, product defect, fraud, willful misconduct, and statutory claims. Where a limitation is invalid, it applies only to the extent legally enforceable.

7. Business Customers, Resellers and Installers

Any purchaser acting for a business, shop, racing team, fleet, or resale operation is solely responsible for its own installation services, representations to customers, advertising, compliance, and downstream use. No purchaser or installer may bind C&J Designs LLC, represent itself as C&J Designs LLC's agent, or issue a warranty on C&J Designs LLC's behalf without prior written authorization. For business transactions, the purchaser agrees, to the extent permitted by law, to defend and indemnify C&J Designs LLC against third-party claims to the extent arising from that purchaser's negligent installation, unauthorized modifications, unlawful conduct, or independent representations, excluding claims to the extent caused by C&J Designs LLC's own wrongful conduct. Material commercial transactions should also use C&J Designs LLC's separately accepted Commercial and Custom Order Addendum.

8. Orders, Returns and Shipping

Payment is due as shown at checkout. Processing times vary by product. ALL SALES ARE FINAL. C&J Designs LLC does not accept change-of-mind returns, exchanges, or cancellations as a matter of policy. C&J Designs LLC may, in its sole discretion, approve or deny a voluntary return, exchange, cancellation, or refund request after individual review; no request guarantees approval, and any exception must be authorized in writing. A voluntary exception in one transaction does not establish a precedent. Returns, refunds, and other remedies required by applicable law remain available. The Return & Refund Policy governs requests and procedures. Shipping, delivery, international duties, and delay procedures are governed by the Shipping Policy. Mandatory cancellation, delivery, and refund rights remain applicable.

9. Custom Products

A custom or specially modified order is binding only when C&J Designs LLC accepts its specifications and price in writing. All custom-product sales are final except for a voluntary exception expressly approved in writing by C&J Designs LLC or a remedy required by applicable law. C&J Designs LLC may decline requested changes or cancellations once an order is accepted, subject to applicable law and expressly agreed order-specific terms. Purchaser-provided measurements, specifications, or design instructions are the purchaser's responsibility.

10. Intellectual Property and Website Use

C&J Designs LLC retains all rights in its designs, product photography, text, logos, drawings, and other protected materials. Purchase of a product does not transfer intellectual property rights. Customers may not copy, reproduce, reverse engineer in violation of applicable law, or commercially exploit protected materials without authorization. Customers must provide accurate order information and may not misuse the website.

11. Events Outside Our Control

C&J Designs LLC is not responsible for performance delays caused by circumstances beyond its reasonable control, including carrier disruption, supplier interruption, natural disaster, government action, or infrastructure outage, except for obligations that applicable law does not allow us to avoid. We will comply with applicable requirements concerning delayed shipments, customer consent, cancellation, and refunds.

12. Disputes and Governing Law

Customers are encouraged to contact candjdesigns.us@gmail.com first so we can attempt to resolve concerns informally. California law governs to the extent legally permissible, without removing mandatory consumer protections that apply elsewhere. Courts with lawful jurisdiction may hear disputes; no provision here prevents legally protected regulatory complaints or statutory remedies.

13. General Provisions

If any provision is invalid or unenforceable, the remainder remains effective to the extent permitted by law. Failure to enforce a provision once is not a waiver of future enforcement. These Terms, together with policies incorporated by reference and any expressly agreed order-specific terms, form the applicable purchase agreement. Changes apply prospectively and do not retroactively alter completed orders.
